In Florida, there are two types of probate: summary administration and formal administration. A summary administration is, in effect, the shortened version of probate. Typically, it can be completed within about 90-120 days.

In order to qualify for summary administration, the non-exempt assets must be $75,000 or less. This does not include exempt assets such as the homestead. In addition, there must be no creditors or there must be provision made for payment of the creditors. All other estates must file a formal probate.
